Welcome to ALIVE Movement Studio Inc. These terms and conditions ("Terms of Service," "Terms," or "Agreement") govern your use of the ALIVE Movement Studio Inc. website, including all associated websites and apps (collectively, the "Site") as well as our affiliated companies (collectively referred to as "ALIVE Movement Studio Inc.," "we," "us," or "our"). By accessing or using the Site and its digital properties, you agree to abide by these Terms of Service. Please carefully review these terms before using the Site. If you do not agree with these Terms, please exit the Site and cease using ALIVE Movement Studio Inc. services.

ACCOUNTS

To access specific features of the website, you must create an ALIVE Movement account. Unauthorized use of another person's account is strictly prohibited. When setting up your account, please provide accurate and complete information. You are responsible for all activities occurring on your account and must promptly report any security breaches or unauthorized usage. Maintaining duplicate ALIVE Movement accounts under the same account holder name, email address, phone number, or physical address is not allowed. ALIVE Movement Studio Inc. reserves the right to merge such accounts without prior notice. Duplicate accounts used to access promotions or offers not intended for the account holder may result in full charges for services received.

MEMBER SERVICES AND POLICIES

CANCELLATIONS

To avoid credit deduction or fees, you must cancel a class at least 5 hours in advance (unless otherwise specified).

Unlimited Memberships are subject to a $10 fee for late cancellations and a $15 fee for no-shows.

Class packages, please note that late cancellations or no-shows will result in the loss of that class credit.

Late cancellations include switching time slots within the cancellation time frame. Cancellations can be made online or through the app. Please note we do not accept cancellations via the phone or email. Cancellation/No-show fees apply regardless of the cancellation method. Special circumstances or emergencies can be addressed by contacting us at info@alivemovement.ca.

REFUND POLICY

CLASSES: All classes and credit packages are non-refundable.

MEMBERSHIP: Unlimited membership packages are non-refundable. Unlimited memberships can be canceled anytime by contacting us via email. No refund will be provided for any unused portion of membership or other fees already paid.

RETAIL ITEMS: Unused merchandise is eligible for a full refund within 7 days of purchase, issued to the original payment method. After 7 days, we will issue a store credit valid for up to 30 days. No returns or exchanges without a receipt. For assistance with purchases or returns, please contact info@alivemovement.ca or visit us in studio.

GIFT CARDS: All gift cards are non-refundable and cannot be exchanged for cash. Lost or stolen gift cards will not be replaced.

RESERVATIONS

You must arrive at least 5 minutes before the scheduled class start time, or your reserved spot may be given to a waitlisted client.

AGE RESTRICTIONS & YOUTH POLICY

In-person classes are accessible to individuals aged 12 and older. Youth aged 12 to 17 must be accompanied by an adult. Hot classes are restricted to participants aged 16 or older.

WAITLIST

Even if a class is full, we recommend adding yourself to the waitlist. Last-minute cancellations may open up opportunities to join the desired class. When a cancellation occurs, the first waitlisted individual is automatically added to the class, and an notification is sent. If added from the waitlist, you are responsible for attending or cancelling, with applicable fees for late cancellations.

UNLIMITED AUTO RENEW MEMBERSHIPS

BILLING PERIOD

All Unlimited Auto-Renew Memberships are billed every 28 days.

MEMBERSHIP PAUSES

Members on the monthly Unlimited Auto-Renew plan can freeze their membership twice per year. Each freeze must be for a minimum of 2 weeks and a maximum of 2 months. All freeze requests must be submitted in writing via email at least 5 days prior to your freeze start date. Please note, the membership year begins from your first enrolment date, not the calendar year.

MEMBERSHIP CANCELLATIONS

You can cancel your membership before your next billing date. There’s no minimum commitment; however, unused portions of your membership are non-refundable. Cancellation requests must be emailed to info@alivemovement.ca at least 5 days prior to your billing date.

GUEST PASSES

As an Unlimited member, you’ll receive 1 complimentary guest pass per billing cycle. Please note, guest passes are not cumulative—if you don’t use it within the billing cycle, it will expire.

CLASS CREDIT EXPIRY

Single class credits, as well as 5 and 10 class packages, come with a 6-month expiry (unless otherwise noted). The 6-month period begins from the date of purchase. Our intro offer of 2 classes for $29 has a 2-month expiry, starting from the date of purchase.

PERSONAL BELONGINGS

ALIVE Movement Studio Inc. is not liable for the safekeeping of personal belongings. You assume all risk of loss for your personal items. Lockers are provided for added security, you can use your own lock or borrow one from the front desk.

LATE ARRIVAL

Please plan to arrive early for class! To ensure a smooth experience for everyone, we have a strict no late entry policy and won’t be able to allow entry more than 2 minutes after the start time. Thank you for helping us create a relaxing and enjoyable environment for all! If you are not checked in at the front desk within 5 minutes before the class starts, and there are waitlisted clients, available spots may be given to them, and your reservation may be forfeited.

PRACTICE ROOMS & STUDIO

ALIVE Movement is a community space. Feel free to relax in our lounge or socialize in the practice space. Please note that the practice room is not a silent zone, so conversations may occur until class begins. Please store personal belongings such as bags and cell phones in provided lockers. Leaving the room during class is discouraged unless it is an emergency. If you need to leave early, please exit quietly and respect the space of others.

SEVERABILITY

If any provision of these additional Terms is deemed invalid by a court of competent jurisdiction, it shall be separated from the remaining provisions, without affecting their validity or enforceability.

PRIVACY

ALIVE Movement Studio Inc. respects your privacy and handles personal information in accordance with our Privacy Policy, available on our website.

GOVERNING LAW

This Agreement is governed by the laws of Ontario, Canada.

BEHAVIOR

ALIVE Movement strives to maintain a pleasant, healthy, and respectful environment. Harassment in any form – verbal, physical, or visual – will not be tolerated. We encourage all guests and team members to treat each other with respect.

NON-HARASSMENT POLICY

ALIVE Movement Studio Inc. condemns unwelcome, inappropriate, and offensive conduct by its personnel or members. If you experience such conduct, we urge you to inform the individual involved (if comfortable doing so) and promptly notify our team at info@alivemovement.ca. Please provide as much detailed written information as possible, including date, time, location, witnesses, and a description of the incident.

ALIVE Movement Studio Inc. is committed to investigating reported incidents and ensuring due process. While confidentiality will be maintained to the extent possible, our duty to investigate may require the disclosure of certain information.

TERM

These Terms of Service apply while you use ALIVE Movement Studio Inc. services or are a Member. You can terminate your membership at any time by contacting us via email. We may terminate your membership at our discretion if you breach these Terms of Service. Even after membership termination, these Terms remain in effect.

FEES

ALIVE Movement charges fees for its services and may change these fees at our discretion. If we terminate your membership due to a breach of these Terms, you may not receive a refund for any unused portion of membership or other fees.

CHANGES TO THIS AGREEMENT

These Terms may change as our business evolves. We will post revised Terms here, and changes will be effective immediately. Continued use of ALIVE Movement Studio Inc. services constitutes acceptance of these changes. We recommend saving a copy of these periodically updated Terms for your reference.

THIRD PARTY SITES

Our Site may contain links to third-party sites not owned or controlled by ALIVE Movement Studio Inc. We have no control over their content or practices and recommend reviewing their terms and privacy policies.

MEDIA RELEASE

I hereby grant Alive Movement Studio Inc. an irrevocable and unrestricted right, unless I expressly state otherwise, to use my image, likeness, photographs, video content, audio recordings, or any other form of recording that may capture my participation in studio classes. This grant extends worldwide and indefinitely. I also consent to Alive Movement Studio Inc. sharing photos or videos of my participation in classes on its social media platforms without requiring my explicit permission, unless I specify otherwise.

LIABILITY AND RELEASE WAIVER

I acknowledge that I have read and fully understand the terms and conditions stated in this liability and release waiver. I understand that my participation in Pilates, yoga, and fitness classes and activities at Alive Movement Studio Inc. may involve certain risks and potential injuries. Despite the precautions taken by the studio, accidents and injuries may still occur. By accepting this form, I willingly assume all risks associated with my use of any and all spaces used by Alive Movement Studio Inc.

I acknowledge and understand that it is my sole responsibility to consult with a medical professional before starting any new physical activity, including but not limited to Pilates, yoga, or other forms of fitness classes. I confirm that I have no known medical condition that would prevent me from safely participating in fitness classes at Alive Movement Studio Inc. I also assume all risks associated with my participation in the classes offered by Alive Movement Studio Inc.

By signing this release form, I, the participant or parent/guardian, agree to release and hold harmless Alive Movement Studio Inc., its teachers, owners, staff members, and facilities used by Alive Movement Studio Inc. from any cause of action, claims, or demands now and in the future. I understand and agree that I will not hold Alive Movement Studio Inc. liable for any personal injury or personal property damage that may occur on the premises, before, during, or after classes. Furthermore, I acknowledge my responsibility to follow all class and facility rules and accept full accountability for my behaviour, including any damage I may cause to the facilities utilized by Alive Movement Studio Inc.

I am aware that Alive Movement Studio Inc. is licensed, accredited, and insured. If I witness any unsafe conduct or conditions before, during, or after my classes, I agree to report such conduct or conditions immediately

to the owner, manager, individual instructor, or staff member of Alive Movement Studio Inc.
